Labor candidate Kate Ganley conceded defeat today.
"Though counting is still ongoing, and the Katherine vote is very close, it appears clear that we've missed out this time," Ms Ganley said on social media today.
"I'm disappointed of course, but am thrilled to see that Chief Minister Michael Gunner and Territory Labor have been chosen by voters to lead us through the next four years."
Counting is still continuing but preferences have now separated Ms Hersey from her Labor opponent who performed more strongly than expected in the Saturday poll.
The final result in Katherine may not be known for days yet.
It is clear the return of Katherine to the CLP fold after the single term from Labor's Sandra Nelson will mean Ms Hersey will be in Opposition.
Labor has claimed it has the numbers to claim a majority and a second term in government for the next four years.
The exact make-up is still unknown as counting continues to separate some close calls.
The Katherine count will continue through the week.
One of those close shaves was Arnhem's Selena Uibo who has fought off independent Ian Gumbula to score a narrow win.
Interestingly in the Arnhem poll, it was the first time the Tindal RAAF Base had been included in the electorate after a redistribution and most votes from the base were for the third-placed CLP candidate Jerry Amato.
There are still lots of votes to count in Arnhem as well but the result looks assured.
Katherine produced another tight result with the conservative vote split between Ms Hersey and Territory Alliance Melanie Usher who has finished in third spot.
Ms Ganley came in late to the election and performed better than many expected and could yet win the primary polling, or first past the post.
In 2016, Sandra Nelson scored 1274 primary votes and won despite being behind due an exhaustive preference count.
Independent Clinton Booth had recorded 188 primary votes up to the last count, another late entrant to the poll.
Ms Hersey was unveiled as the CLP's candidate in November last year and did not waste time with old-fashioned electioneering, including door-knocking the entire town.
Her hard work, and the early announcement, appears to have helped as have the preference flows from Ms Usher.
